Betting licence procedures under tight EU scrutiny
13/09/2007: The European Gaming and Betting Association (EGBA) welcomes the ruling of the European Court of Justice in the case (C-260/04) concerning the renewal of horse race betting licences in Italy which states that “the Italian Republic failed to fulfil its obligations under Articles 43 (freedom of establishment) and 49 (freedom to provide services) of the EC Treaty“. In particular, the Court found that „the Italian authorities infringed the general principle of transparency and the obligation to ensure a sufficent degree of advertising“. Today’s court decision is in line with previous ECJ rulings reached in the Gambelli and Placanica cases
Le procedure italiane di assegnazione delle licenze per le scommesse messe sotto esame dall’Unione Europea
13/09/2007: La European Gaming and Betting Association (EGBA) accoglie con soddisfazione la sentenza della Corte di Giustizia Europea (ECJ) nel caso relativo al rinnovo delle licenze per la raccolta di scommesse ippiche in Italia, che specifica che : “La Repubblica italiana è venuta meno agli obblighi ad essa incombenti in forza degli artt. 43 CE (Liberta’ di stabilimento) e 49 CE (Libera prestazione dei servizi) “. In particolare, la corte ha stabilito che : “ l’Italia ha violato il principio generale di trasparenza nonché l’obbligo di garantire un adeguato livello di pubblicità“.
Wettlizenzen: Vergabepraxis auf dem EU-Prüfstand
13/09/2007: Die EGBA (European Gaming and Betting Association) begrüßt die heutige Entscheidung des Europäischen Gerichtshofs (EuGH) in Zusammenhang mit der Verlängerung von Pferdewettlizenzen in Italien. Dem Urteil zufolge hat die italienische Republik gegen ihre Verpflichtungen aus den Artikeln 43 und 49 des EG-Vertrags zur Niederlassungs- und Dienstleistungsfreiheit verstoßen. Insbesondere habe Italien „den allgemeinen Transparenzgrundsatz und die Verpflichtung, einen angemessenen Grad von Öffentlichkeit sicherzustellen“, verletzt. Die heutige Entscheidung des EuGH steht im Einklang mit der bisherigen Rechtssprechung des Gerichtshofs in den Rechtssachen Gambelli und Placanica.
